1. Acceptance of Terms

By downloading, installing, or using the Cole application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App. The App is operated by Toi Studios (“we,” “our,” or “us”).

2. Description of Service

Cole is an AI-powered content analysis application that processes screenshots, links, text, and media through various plugins including fact checking, summarization, translation, identification, explanation, and sentiment analysis. Results are generated by artificial intelligence and should be used as a reference, not as definitive truth.

3. Account Registration

To use Cole, you must create an account using Sign in with Apple or phone number verification. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. Subscriptions and Payments

Cole offers both free and paid subscription tiers:

• Free: 3 asks per month, 100 MB storage.
• Buddy: 30 asks per month, 500 MB storage.
• Pal: 150 asks per month, 5 GB storage.
• Ally: 500 asks per month, unlimited storage.

Paid subscriptions are billed through Apple's In-App Purchase system. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account settings.

5. User Content

You retain ownership of all content you submit to Cole. By using the App, you grant us a limited license to process your content through our AI services solely for the purpose of providing analysis results to you. We do not use your content to train AI models.

You agree not to submit content that:

• Violates any applicable law or regulation.
• Infringes on the intellectual property rights of others.
• Contains malware or harmful code.
• Is intended to abuse, overload, or disrupt our services.

6. AI-Generated Content Disclaimer

Cole's analysis results are generated by artificial intelligence and third-party services. While we strive for accuracy, we do not guarantee that any result is correct, complete, or up-to-date. Fact-check verdicts, summaries, translations, and other outputs are provided for informational purposes only and should not be relied upon as professional advice or definitive statements of fact. Always verify important information through additional sources.

7. Intellectual Property

The App, including its design, features, code, and branding, is owned by Toi Studios and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Toi Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App settings.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
